Hello,
I have previously contacted an attorney from NY which has been very successful with O-1 visa applications. He has helped two people I know and apparently has a 100% success rate (I suppose that could come from only choosing cases he's sure will go through). This attorney has reviewed my CV and stated I certainly qualify for the O-1 visa. This guy is also very expensive.
My employer is willing to pay for all visa expenses, as long as it's through their own law firm (which charges about $5000 less than the NY guy). So my question is: as long as the CV is strong, is it possible an attorney could screw up the application, by not preparing it very well? Basically, I am trying to decided whether I should suggest to my employer eating up the cost difference so that I can work with the guy from NY.
Any advice welcome.

I have received an RFE on my I-485 application to provide a copy of birth certificate. However, I have submitted the birth certificate and affidavits from my parents when I filed for I-485.
I am from India. Since the name is put after few months of birth, my name is not present in the birth certificate. I am not sure if the RFE is due to this. But all the (or most) people from India would be in the same zone, right (not having name in birth certificate) ?
Is anyone in the same situation as me ? What kind of documents have you submitted for the birth certificate requirement ?

I am assuming your wife is H4? H4 to F1 shouldnt be a problem, this is the same path I took years ago before becoming H1.
There is only one issue I can think of and that is travelling outside the country. She might not be issued an F1 visa stamp at a consulate for travel outside the country since her H4 was based on yours which now has immigrant intent since you applied for PERM (LCA and I-140). The consulate will probably not believe she has non-immigrant intent. She would have to stay in the country until she changed to H1 and got that stamped, or until you get AP for both of you. But if you have no plans to leave the country I dont see that as an issue. Best to consult a proper immigration attorney since all I can tell you is my experience.

Hi
I am currently on H1b and I have applied for an extension around July 14th. My i-94 is expiring on
Sept 20th. My husband is currently on F-1. I wanted to find out in case my H1b visa is rejected, will

If the rejection comes after the I-94 expiry date then theoretically yes. However, check with an attorney on any "grace period" (sometimes the denial notice mentions 10 days or 30 days).
You can convert to F2 as long as you have not applied for I-140 (shown immigrant intent).
You can also file a new H1B or file a "motion to reconsider" if you have new supporting documents or a change in circumstances.

even if the bill passes ,we r not getting much relief if in eb3.we should be trying for a amendment to remove country cap or file i-485.time is slipping from our hand s though and only lobbyist can do anything at this point

The battle for comprehensive immigration reform is going to be tough as Senate Republicans play politics with the critical immigration issue. The Senate passed its $44.3 billion fiscal 2010 Homeland Security appropriations measure 84-6 last week after three days of debate that differentiated the bill from its House companion on a handful of border security and immigration policies. Unfortunately Senate Republicans used the opportunity to add significant new provisions to the less controversial �extender provisions� including an extension to the Special Immigrant Nonminister Religious Worker Program and the Conrad Waiver Program for Physicians Serving in Underserved Areas. I think it should be fine as long as the visa page is not tampered or damaged, and the electronic information can be read. Also since she has a new pp, it should not be a problem. She should carry both the old and new pp with her.

Last week friday my advance parole document from NSC was approved & sent , but we have not received the approved document yet.

I have finished my 1st MS and was doing my 2nd MS
In fall semester I applied for all online courses and when it was the time of exam I had to leave to India as my Grandfather was very sick.
I was in lot of pressure as I was very close to them so I left. Before leaving I did asked the admission officer in university and she told that I will get all F grades and I can take same courses again in Next semester.
I was ready to do that. So I left USA and came back in January. 2 days before I received a letter from university that I have been dropped off. I was shocked and tried contacting the admission officer. She told me that they can reinstate now for my F1 visa and thats the only way.
I want to know if these is the only way or if there is some other way to get back in status. I dont want to leave country and come back to get reinstatated as I think its too risky.
What are the chances of reinstatement if I have clean history as well as no work records from the time I entered in USA. I have been student from last 4 years from the time I entered USA.
I do want to apply for visitor visa in future. HOw will these situation affect that
